WHAT WE DO

​​PERSONAL INJURY

Personal Injury is a body of law whether stemming from Common Law or created by Statute commonly referred to as Tort Actions.  In Tort actions, the person filing the lawsuit, usually called the Plaintiff,  files a civil lawsuit seeking compensation, usually monetary, for injuries to their person and/or their family members that was cause because of someone else’s negligent and/or intentional action and/or in action.   Personal Injury refers to injury to the person and can be based on intentional conduct such as Battery, Assault, False Imprisonment to name a few or it can be based on Negligent conduct, where the offending party did not intend to injury the individual but they cause injury/harm to others by negligently doing an act or failing to do an act that they are required to do to prevent the harm caused.

 In Florida there are time limits in which to file your lawsuit if you have been injured.  The is called he Statute of Limitation and it is usually 4 years from the date you were injured.  However, in some case, the statute of limitation varies and can be shorter or longer depending on the circumstances.  For instance in a Wrongful Death Action and Medical Mal-Practice the Statute is only 2 years.  As such, it is very important that if you have been injured due to someone else’ negligence that you consult with an attorney as soon as possible.

  • WRONGFUL DEATH

Wrongful Death action is the name of the lawsuit that is filed when someone dies because of another’s negligent and/or intentional conduct.    Typically there is a two year statute of limitation within which to file a wrongful death action.  If the lawsuit is not filed within two years of of the death, the action may be forever barred and the survivors of the decedent may not get compensated for their loss.   Typically the Action is brought by the survivors/beneficiaries of the decedent and Florida Statute Section tells you which survivor/beneficiary can bring a wrongful death action. 

Furthermore, a wrongful death action can only be brought by the Personal Representative of the Decedent, therefore Probate would have to be opened and the Probate Court would have to appoint a Personal Representative if the person dies intestate without a will.  If there is a will that names a Personal Representative that person would most likely be designated as the Personal Representative unless the person declines, is deemed incompetent or there is a challenge to the will.

  • SLIP, TRIP OR FALLS

Slip, Trip and Fall case, commonly called Premises Liability, occur when an individual slips and falls on someone else’s property.  In Florida, there are many factors to consider in a slip, trip and fall case.   One is whether the property owner had prior notice of the condition which causes you to slip, trip or fall.    Further, there is also an issue as to whether the injured party had a right to be where the incident giving rise to the injury occurred.   The property owner’s duty to the injured party depends on whether the person was an invitee, of the property owner, or a trespasser.
